EUROPE IN FRAME
EDITORIAL STANDARD LICENCE
Version 1.0

1. Licence grant

Europe In Frame grants the licensee a non-exclusive, non-transferable, worldwide licence to use the licensed photograph for editorial purposes, subject to these terms.

The licence applies only to the photograph identified in the relevant order or licence record.

2. Duration

The licence is granted for an indefinite period, subject to compliance with these terms.

3. Permitted editorial use

The licensed photograph may be used in:
- editorial articles;
- books;
- newspapers and magazines;
- news publications;
- educational publications;
- documentary publications;
- other non-advertising editorial publications consistent with these terms.

The photograph may be used in digital or print editorial publications within the scope of this licence.

4. Commercial, advertising and promotional use

Commercial advertising, promotional campaigns, product marketing, endorsements and other promotional or advertising uses are not permitted under this licence.

Use by a commercial publisher or other commercial organisation is not prohibited merely because the organisation operates commercially, provided that the actual use of the photograph is editorial and otherwise complies with these terms.

5. Limited modifications

The licensee may make reasonable technical and editorial adjustments required for a permitted editorial use, including resizing, cropping and ordinary colour or exposure adjustments.

The photograph may not be materially altered in a deceptive manner or modified so that it misrepresents the subject, context or meaning of the photograph.

Such adjustments do not transfer copyright or create ownership rights in the licensed photograph.

6. Attribution

Attribution is required.

Where reasonably practicable, the credit must read:

If the publication format does not reasonably permit that exact placement or form, the credit must be provided in a customary and reasonably visible editorial credit location.

7. Territory

The licence is valid worldwide.

8. Resale, sublicensing and redistribution

The licensed photograph may not be:
- resold as a standalone asset;
- sublicensed;
- transferred to another person or organisation as an independent licensed asset;
- redistributed as a standalone downloadable file;
- uploaded to a public file repository or file-sharing service;
- offered in a stock library, template, asset pack or image collection;
- incorporated into a product whose primary value is the photograph itself.

Supplying the photograph only as technically necessary to a printer, publisher, designer or production provider acting on behalf of the licensee for a permitted editorial use does not constitute prohibited redistribution, provided that the recipient receives no independent right to use the photograph.

9. Artificial intelligence and machine learning

The licensed photograph may not be used to train, fine-tune, evaluate or develop an artificial intelligence or machine-learning model, or included in a dataset intended for such purposes, unless Europe In Frame grants separate written permission.

10. Ownership and copyright

Copyright and all ownership rights in the licensed photograph remain with the copyright holder.

Purchasing or licensing the photograph does not transfer copyright, authorship or ownership of the underlying photographic work.

This licence grants usage rights only.

11. Prohibited use

The licensed photograph may not be:
- used unlawfully;
- used deceptively or in a materially misleading editorial context;
- represented as the licensee's own original photographic work;
- used in a way that falsely suggests sponsorship, endorsement or affiliation;
- used outside the scope of the editorial rights expressly granted by this licence.

12. Termination

Europe In Frame may terminate this licence if the licensee materially breaches these terms and, where the breach is capable of remedy, fails to remedy it within a reasonable period after receiving notice.

Upon termination, the licensee must cease any use that is no longer authorised by this licence.

Termination does not affect any mandatory rights or remedies available under applicable law.

13. Mandatory rights

Nothing in this licence excludes, restricts or limits any right, remedy, guarantee or protection that cannot lawfully be excluded, restricted or limited under applicable law.

Where mandatory law conflicts with these licence terms, the mandatory law prevails to the extent of that conflict.

14. Licence version

These are the Editorial Standard Licence terms, version 1.0.

The licence applicable to a purchase is the version identified and recorded with the relevant order.
